How the Statutory Residence Test works

1. Automatic overseas tests

If any apply, you're non-resident: fewer than 16 UK days (if previously resident), fewer than 46 (recent arrivers), or full-time work overseas with limited UK days.

2. Automatic UK tests

If any apply, you're resident: 183+ days in the UK, your only home is in the UK, or you work full-time in the UK.

3. Sufficient ties test

If neither is conclusive, your number of UK ties (family, accommodation, work, 90-day, country) is weighed against your UK days — with different thresholds for 'arrivers' and 'leavers'.

Important: your company is different

Even if you are non-resident, your UK company is still UK tax resident and pays Corporation Tax — regardless of where you live.
